Sportswink respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following process for addressing claims of copyright infringement.
1. Notice of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on SportsWink infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
- Electronic or Physical Signature: A signature of the person authorized to act on behalf of the owner of the copyright interest.
- Identification of the Work: A clear description of the copyrighted work that you claim has been infringed.
- Identification of the Material: The specific URL(s) on sportswink.com containing the material you claim is infringing (so we can locate it quickly)
- A “Good Faith” Statement: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Perjury Statement: A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
2. Our Takedown Process
Upon receipt of a valid, complete notice, SportsWink will:
- Expeditiously remove or disable access to the allegedly infringing content.
- Notify the user who uploaded the content that it has been removed.
- Maintain a record of the notice to identify repeat infringers.
3. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to our agent. This must include your contact info, identification of the removed material, and a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located.
4. Repeat Infringer Policy
SportsWink takes copyright seriously. Users who are identified as “Repeat Infringers” (those who have been the subject of multiple valid DMCA notices) will have their accounts permanently disabled and will be barred from uploading future content to our platform
